Nassar Land Update

Dear Friend,

I would like to update you regarding the latest developments in the Nassar Land Case. The Israeli Supreme Court on its first Court meeting on the 9th of July after four postponements found the reasoning behind the decision of the Military Court confiscating a big part of the land of the Nassar family insufficient and unacceptable. The Supreme Court however did not overturn the decision of the Military Court and instead it ordered it to detail the reasoning behind its decision.

The Military Court presented in 23.9.2003 to the Supreme Court a paper containing reasoning behind its decision declaring a big part of the land of the Nassar Family as "State Land". In its paper the Military Court basically adopted the claims of the Military Prosecutor who claimed the Nassar Land was State Land. The Nassar family had 30 days to respond and to present all its evidence. The attorneys for the Nassar family presented their response to the decision of the Military Court and stated that the claims and reasoning of the Military were absurd. In addition the attorneys for the Nassar family have requested from the court an extension of an additional 45 days in order to present additional maps drawn by Israeli experts. The attorneys of the Nassar family have decided to use the opportunity presented by the Supreme Court to present additional evidence in order to present expert opinions and maps of the top Israeli surveyors and experts in this field in addition to all the evidence presented the first time by the Nassar Family. The top Israeli expert Mr. Kraus has been hired to present his opinion. The costs of opening the case again are substantial. The attorney fees shall be an additional $12,000 and the Israeli expert Mr. Kraus is requesting and fees totaling $15,000 ($13,000 +VAT) but these costs are crucial as the Supreme Court will have a much more difficult time upholding the decision of the Israeli Military Court in light of such over whelming evidence and the opinions by the top expert in Israel itself.
